🏛 Legal Update: Commonwealth v. Sanborn (2017)
Can you stop a vehicle to issue a temporary protective order (TPO)?
Massachusetts Supreme Judicial Court ruled that police cannot stop a motor vehicle solely to serve a civil abuse prevention order (commonly called a 209A order). The court held that such a stop violates the Fourth Amendment and Article 14 of the Massachusetts Declaration of Rights unless it is supported by a warrant, reasonable suspicion of criminal activity, a traffic violation, or another exception to the warrant requirement.
